Last month, on December 17, Tory Lanez (Daystar Peterson) gave his first on-camera interview since being convicted and sentenced to 10 years for the July 2020 shooting of Megan Pete, known to us all as Megan Thee Stallion. He spoke with NBC News from inside the California Men’s Colony prison in San Luis Obispo.
He and his legal team also announced plans to file an appeal with the California Supreme Court. They’re also pushing for a pardon or clemency from California Governor Gavin Newsom. This could mean a full pardon to clear his record, or a commuted sentence, allowing his release with his record still intact.
Even though Lanez consistently maintained his innocence, a jury found him guilty in December 2022 on three felony charges: assault with a semiautomatic handgun, carrying an unregistered firearm in a vehicle, and discharging a firearm with gross negligence. His 10-year prison sentence was handed down in August 2023.
Tory Lanez Alleges Brady Violation and Withholding of Key Evidence
During the trial, Lanez’s defense team claimed that Megan Thee Stallion’s former best friend, Kelsey Nicole Harris, was the actual shooter. Now, in their new appeal, Lanez and his legal reps are accusing prosecutors of a ‘Brady violation.’ For those unfamiliar, the ‘Brady rule,’ established in 1963, legally obligates prosecutors to disclose any material or potentially favorable evidence to the defense. It’s a big deal.
The team claims critical evidence was withheld during the trial itself. They point to records from Megan Thee Stallion’s recent civil defamation lawsuit, suggesting these documents contain information never given to Lanez’s defense. Lanez himself told NBC News:
“I believe not only that I was wrongfully convicted, but the amount of new evidence that has emerged since that trial, I think, has been overwhelming.”

Just days after Lanez’s NBC interview, TMZ backed up these claims. On December 22, the outlet reported that his legal team is indeed pursuing action against the former Los Angeles District Attorney, George Gascón, regarding his case.
Lanez’s team has presented new court documents, including testimony from a software expert. This expert reportedly reviewed Megan Thee Stallion’s medical records from the 2020 shooting night, signing off on a report that alleges Gascón’s office presented 60 fraudulent errors in the medical findings used during Lanez’s 2022 trial.
Among the ‘most alarming’ findings in the expert’s report is a missing document simply titled “EVIDENCE.” This document allegedly states that a hospital guard, Derek Cervantes, bagged, tagged, and transferred “foreign bodies”—aka bullet fragments—to the hospital where Megan received treatment.
At trial, detectives testified that the defense received all medical records and that no bullet fragments were recovered. However, Lanez’s team asserts that this new expert report directly challenges that testimony.
TMZ detailed other red flags from the report: “altered or overwritten text, QR codes that don’t work, fake signatures, inconsistent document formatting, and missing and repeated pages with date and time contradictions.” The expert also revealed approximately 300 pages of information were allegedly withheld from Lanez and his attorneys.
Adding to the mystery, Lanez’s legal team also claims they cannot locate Dr. Milton Little, the orthopedic trauma surgeon from Cedars-Sinai who operated on Megan Thee Stallion’s gunshot wounds and conspicuously failed to testify during the trial.
