Halle Berry has spent decades navigating public heartbreak. Her 1990s divorce from David Justice played out under intense media scrutiny. Her marriage to Eric Benét imploded over infidelity she discussed tearfully with Oprah. Her custody battle with Gabriel Aubry over their daughter Nahla became another headline-making ordeal. Each chapter of her personal life seemed to invite judgment from strangers with opinions about her choices, her judgment, her worth as a partner.
But this latest custody battle with ex-husband Olivier Martinez over their 13-year-old son, Maceo, feels different. It’s not another divorce or a former couple trading accusations in the tabloids. This is Halle Berry watching her relationship with her own child become a battleground.
Earlier this week, Maceo testified for four hours before a judge. When he finished, he walked to his father and didn’t acknowledge Berry. Entertainment Weekly and Page Six reported that Nahla is also expected to testify at some point during the proceedings.
The custody dispute erupted in October when Martinez alleged that Berry physically abused Maceo during a September 2026 incident. He claimed she choked their son and put her hands on him, filing for temporary full custody and a restraining order against her. Berry’s legal team immediately called the claims meritless and deliberately misleading.
Court documents later revealed a longer, more complicated relationship between all three of them. Martinez alleged photo evidence showed bruising from the altercation. Berry countered by claiming the photo shows her standing calmly with her hands in her pockets, several feet from their son, with no visible injuries to support his allegations.
On Friday, Page Six reported that Martinez doubled down on his abuse allegations during cross-examination, despite being confronted with a previous sworn statement. When Berry’s attorney presented a September 2024 declaration where he confirmed there was no history of domestic violence between them, Martinez acknowledged the statement was true when he signed it.
There’s also been the matter of courtroom drama. Eyewitnesses claimed Martinez stormed out during a break, cursing while with his lawyer. His legal team later told BlkCosmo it was a misrepresentation, saying he simply needed a bathroom break.

There’s a pattern worth noting here. For years, certain corners of the internet have blamed Berry for the relational turmoil she’s endured. They’ve based their reasoning on claims about her poor discernment when picking partners. But that reasoning doesn’t hold up. Even if someone makes poor choices in romantic partners, that doesn’t excuse those partners for their behavior. It doesn’t mean she deserves a fractured relationship with her son or that she’s earned this kind of familial strife.
Whatever mistakes Berry may have made in her personal life, they don’t negate her right to maintain a loving, respectful relationship with her child. No romantic fallout compares to the pain of watching that bond become another public spectacle.
There’s been no word yet on how long the proceedings will last or when a ruling might come down. For now, the case continues to play out in court, with a 13-year-old boy at the center of it all.
