The split between Kandi Burruss and Todd Tucker just got a whole lot more complicated. Todd is now officially demanding primary custody of their two children, Ace, 8, and Blaze, 5, according to new court documents.
In a recent filing, Todd responded to the divorce petition from Kandi Burruss, claiming the kids are already living with him in Georgia. He argues that Kandi’s busy work schedule will keep her out of state for the next few months, making him the more stable parent for now. It’s a bold move that changes the tone of their separation.
Even while making this power play, Todd’s filing kept it respectful. He made a point to praise Kandi as a “loving and capable parent,” noting that they’ve been trying to work things out cooperatively.
Still, if they can’t reach an agreement, Todd is asking the court for:
- Primary physical custody
- Joint legal custody
- Final decision-making authority
with Kandi still getting “meaningful access” to the kids.
Prenup Drama Unfolds
But the drama doesn’t stop there. Todd is also challenging the prenuptial agreement he signed right before their 2014 wedding.
He claims Kandi’s team presented the final version to him at the last minute, without his lawyers present, which he says raises “substantial questions” about whether the agreement is even valid.
If the prenup gets tossed out, Todd is ready to ask for alimony and an equitable split of all their marital assets—from property to business investments.
Kandi’s Side of the Story
As a reminder, Kandi was the one who filed for divorce on November 21, stating the marriage was “irretrievably broken” with no hope of reconciliation.
She is asking the court to do the opposite:
- Enforce the prenup
- Grant joint custody
- Divide debts according to the prenup
- Determine child support
When she announced the split after 11 years, Kandi said her focus was on peace, growth, and effective co-parenting, admitting the breakup had been “brewing for a while.”
Whew. With conflicting custody demands and a whole prenup on the line, this is quickly turning into one of the messiest celebrity divorces we’ve seen in a while. It seems that peaceful co-parenting future is already being put to the test.
