Will Smith just scored a major legal win after a California judge dismissed a sexual harassment and wrongful termination lawsuit brought by a former touring violinist.
According to court records, Brian King Joseph, who previously performed on tour with Will Smith, accused the actor and members of his team of harassment, retaliation, and wrongful termination tied to an alleged incident during the tour.
After reviewing the case, the judge ruled that the claims did not meet the legal standard required for a sexual harassment lawsuit. The court reportedly found that the conduct described in the complaint was not “sufficiently severe or pervasive” under California law.
At the center of the lawsuit was an unusual alleged hotel room incident. Joseph said he returned to his room and found that someone had entered without permission, leaving behind personal belongings and a note that read, “Brian, I’ll be back … just us,” allegedly signed by someone identified as “Stone F.”
The complaint also alleged that a beer bottle, backpack, earring, hospital paperwork, and HIV medication were left inside the room.
Joseph argued that after reporting the incident to hotel management, he faced retaliation and eventually lost his spot on the tour. But the judge reportedly pointed to major gaps in the complaint, including no direct evidence connecting Smith or his management team to the alleged room entry.
The ruling also noted that Joseph’s hotel room key may have been compromised after his bag was reportedly left unattended in a van shared by multiple crew members before it was returned to him.
Throughout the legal fight, Smith’s attorney, Allen B. Grodsky, denied the allegations and described the claims as false and reckless.
Even with the dismissal, the matter may not be completely closed. The judge reportedly gave Joseph the option to amend and refile the complaint if he can provide additional factual details to support his claims.
For now, the ruling stands as a significant courtroom victory for Smith as he continues navigating public scrutiny and rebuilding his image.
