    The music world was shaken last night as D4vd (David Burke), the viral alt-pop sensation behind “Romantic Homicide,” was taken into custody by the LAPD. But while the headlines are screaming “Murder,” a closer look at the legal mechanics of this arrest suggests the case might be standing on shakier ground than the public realizes.

    The “Suspicion” Loophole

    Here’s what’s wild: D4vd wasn’t arrested on an indictment or formal criminal charge. Instead, he’s being held on “suspicion of murder” in connection with the tragic death of 14-year-old Celeste Rivas Hernandez, whose remains were found in a Tesla registered to the singer last year.

    Typically, after a seven-month investigation this serious, prosecutors would present evidence to a grand jury and secure an indictment *before* making an arrest. That didn’t happen here. There is currently no indictment and no formal criminal complaint filed against David Burke.

    A “Weak” Case Rushed By Flight Risk?

    We reached out to a former Los Angeles prosecutor to understand why the LAPD would move now without formal charges ready. The answer was telling:

    “It’s highly unusual to arrest someone after a year-long investigation without having the charges ready to go. Usually, this only happens if they believe the defendant is a flight risk—meaning they think he was about to leave the country. When you rush an arrest like this, it often means the evidence isn’t fully baked yet.”

    When prosecutors “throw together a case” to prevent someone from fleeing, the evidence is often circumstantial and weak. In similar past instances, the lack of a solid foundation led to cases being dropped entirely within weeks.

    The Monday Deadline

    The Los Angeles District Attorney’s Office has confirmed they are “reviewing” the case but haven’t made a move on charges yet. They’ve signaled that a decision might come by Monday, April 20, 2026.

    If the DA decides there isn’t enough evidence to move forward by early next week, D4vd could potentially walk out of jail a free man—at least for now.

    The Defense Strikes Back

    D4vd’s legal team, led by powerhouse attorneys Blair Berk and Marilyn Bednarski, isn’t backing down. They released a statement late last night:

    “Let us be clear—the actual evidence in this case will show that David Burke did not murder Celeste Rivas Hernandez and he was not the cause of her death. He has only been detained under suspicion. We will vigorously defend David’s innocence.”

    With the cause of death still unreleased due to the advanced decomposition of the remains, the prosecution has a massive uphill battle to prove David Burke was responsible.
